TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale apply to purchases made through the Kuutaro online store at https://kuutaro.eu.

The online store is owned and operated by Elkamar OÜ, registry code 12074989, hereinafter referred to as the Seller or Online Store.

1. Validity of the Sales Terms

1.1. These Terms and Conditions apply to all purchases made through the Kuutaro online store.

1.2. The prices of products are displayed next to each product in the Online Store. All prices are stated in euros.

1.3. Elkamar OÜ is not registered for VAT in Estonia. Therefore, VAT is not added to the prices displayed in the Online Store.

1.4. The delivery fee is added to the price of the goods unless free delivery is offered by the Online Store for the particular order or promotion.

1.5. The delivery fee depends on the delivery method selected by the customer and is displayed before the order is confirmed.

1.6. Product images in the Online Store are for illustrative purposes. In the case of natural stones, minerals, wood and other natural materials, the actual product may differ from the image in colour, pattern, shape, size or texture. Such natural variations do not constitute a defect or non-conformity of the product where the nature of the product has been appropriately described.

2. Placing an Order

2.1. To place an order, the customer selects the desired products and adds them to the shopping cart.

2.2. To complete the order, the customer must provide the required information and select the preferred delivery and payment method.

2.3. Before confirming the order, the customer is shown the total purchase price, including the delivery fee where applicable.

2.4. The order is considered placed once the customer has confirmed the order.

2.5. The sales contract is concluded when the Seller sends the customer an order confirmation and the amount payable by the customer has been received by the Seller or the relevant payment service provider.

2.6. The order confirmation is sent to the e-mail address provided by the customer when placing the order.

2.7. If the ordered product is unavailable, for example because the product has gone out of stock, the Seller will inform the customer as soon as reasonably possible. Any amount already paid will be refunded in accordance with applicable law.

3. Prices and Payment

3.1. All prices displayed in the Online Store are in euros.

3.2. The customer may pay for the order using the payment methods available in the Online Store.

3.3. If the customer chooses a bank link, card payment or another payment service, the payment is processed through the relevant payment service provider’s environment.

3.4. Additional terms and conditions of the relevant payment service provider may apply to payments made through third-party payment services.

4. Delivery

4.1. Products are delivered using the delivery method selected by the customer when placing the order.

4.2. Available delivery methods and their prices are displayed in the Online Store before the order is confirmed.

4.3. The estimated delivery time is displayed in the Online Store or in the order confirmation.

4.4. Delivery times may depend on product availability, the selected delivery method and the destination.

4.5. If delivery is delayed due to circumstances that the Seller could not reasonably foresee or control, the customer will be informed as soon as reasonably possible.

4.6. If the goods are not delivered within the agreed period or within the statutory period, the customer has the rights provided by applicable law.

5. Right of Withdrawal

5.1. A consumer has the right to withdraw from an online sales contract without giving a reason within 14 days from receiving the goods.

5.2. To exercise the right of withdrawal, the customer must submit a clear statement of withdrawal within the 14-day period.

5.3. The withdrawal notice may be submitted using the withdrawal function provided in the Online Store or by e-mail to info@kuutaro.eu.

5.4. When submitting a withdrawal notice, the customer should, where possible, provide the order number, customer name and the products being returned.

5.5. The customer must return the goods without undue delay and no later than 14 days after submitting the withdrawal notice.

5.6. The direct cost of returning the goods is borne by the customer unless the Seller has agreed to bear the return costs or applicable law provides otherwise.

5.7. Following withdrawal, the Seller will refund all payments received from the customer, including the standard delivery cost paid for the original delivery, no later than 14 days after receiving the withdrawal notice. The Seller may delay the refund until the returned goods have been received or until the customer has provided evidence that the goods have been returned, whichever occurs first.

5.8. If the customer selected a more expensive delivery method than the least expensive standard delivery option offered by the Seller, the Seller is not required to refund the additional cost resulting from the more expensive delivery method.

5.9. The customer may examine and handle the goods only to the extent necessary to establish their nature, characteristics and functioning. If the value of the goods has decreased due to handling beyond what is necessary for such examination, the customer may be liable for the resulting reduction in value as provided by law.

5.10. The right of withdrawal does not apply in cases where the law provides an exception, including certain personalised or custom-made goods and sealed goods which are not suitable for return for health or hygiene reasons once the seal has been opened.

6. Returning Goods

6.1. Returned goods must be sent to the return address provided by the Seller.

6.2. Goods must be appropriately packaged to prevent damage during transportation.

6.3. The customer is responsible for any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning.

6.4. In the case of natural products, including stones and minerals, natural variations in colour, pattern, shape, size and texture are not considered defects where such variations are inherent to the product and have been appropriately described.

7. Complaints and Non-Conforming Goods

7.1. The Seller is responsible for ensuring that goods sold to consumers conform to the terms of the sales contract in accordance with applicable law.

7.2. A consumer has the statutory right to submit a complaint regarding non-conformity of the goods within two years from receiving the goods.

7.3. If a defect or non-conformity becomes apparent, the customer should contact the Seller as soon as reasonably possible at info@kuutaro.eu.

7.4. The complaint should, where possible, include the order number, a description of the problem and photographs of the product showing the alleged defect.

7.5. The Seller will review the complaint and respond within the period prescribed by applicable law.

7.6. If the goods do not conform to the contract, the customer has the statutory rights to request repair or replacement and, where provided by law, a price reduction or termination of the contract and a refund.

7.7. Where the costs of repairing or replacing non-conforming goods are the responsibility of the Seller, such costs will be borne by the Seller in accordance with applicable law.

8. Liability

8.1. The Seller is responsible for the conformity of the goods with the sales contract to the extent required by applicable law.

8.2. The Seller is not responsible for damage caused by improper use, maintenance or failure to follow the instructions provided with the product.

8.3. Products made from natural materials have characteristics inherent to those materials. Any care and use instructions provided with the product should be followed.

9. Processing of Personal Data

9.1. The Seller processes customer personal data for the purposes of processing orders, fulfilling contracts, delivering goods, accounting and complying with legal obligations.

9.2. Where necessary to fulfil the order, relevant customer information may be disclosed to payment service providers, delivery service providers and other service providers involved in fulfilling the contract.

9.3. Personal data is processed in accordance with the Online Store’s Privacy Policy.

9.4. Marketing communications and newsletters are sent only where there is an appropriate legal basis or the customer’s consent, where required by law.

10. Dispute Resolution

10.1. If the customer has any questions, complaints or concerns, they may contact the Seller by e-mail at info@kuutaro.eu or by telephone at +372 55647693.

10.2. The Seller will seek to resolve complaints and disputes primarily through communication and agreement with the customer.

10.3. If the customer and the Seller cannot reach an agreement, a consumer customer has the right to contact the Estonian Consumer Disputes Committee or another competent dispute resolution body as provided by law.

10.4. Consumer dispute resolution procedures are subject to the applicable rules and legislation.

10.5. Disputes are governed by the laws of the Republic of Estonia, taking into account any mandatory consumer protection provisions applicable to the customer.

11. Amendments to the Terms and Conditions

11.1. The Seller has the right to amend these Terms and Conditions where necessary due to changes in legislation, the activities of the Online Store or other justified circumstances.

11.2. The Terms and Conditions applicable to an order are those in force at the time the order was placed.

These Terms and Conditions of Sale are effective as of 8 September 2026.
